WhatsAilingMe™ is NOT a medical provider. We do not diagnose, treat, or prevent any disease. Our service helps you and your healthcare providers explore possibilities. Always consult a qualified healthcare professional for medical advice.
1. Agreement to Terms
By accessing WhatsAilingMe™, you agree to these Terms. If you disagree, do not use the Service. You must be at least 18 years old.
2. Description of Service
WhatsAilingMe™ provides:
- Guided health intake and medical record analysis
- Laboratory testing coordination through Quest Diagnostics
- Possibility Reports identifying potential health patterns
- Physician Intake Documents for your healthcare providers
- Optional ongoing health tracking and monthly re-analysis
Our Role
We provide information and analysis tools—not medical diagnoses or treatment recommendations. Our reports support, not replace, your healthcare providers.
3. User Accounts
You are responsible for:
- Providing accurate, complete information
- Safeguarding your password and account
- All activities under your account
- Notifying us of unauthorized access
4. Fees and Payment
Initial Analysis — $750
- Comprehensive health intake
- Lab testing (85+ markers) via Quest Diagnostics
- Analysis of records and health information
- Possibility Report and Physician Intake Document
Optional Subscription — $5/month
- Upload new medical records
- Health update logging
- One re-analysis per month
All fees are in USD and non-refundable except as described below. Cancel subscriptions anytime.
5. Refund Policy
- Before lab work: Full refund
- After lab work, before reports: Partial refund (less lab costs)
- After reports delivered: No refund
- Subscription: Cancel anytime; no partial-month refunds

6. User Responsibilities
You agree to:
- Provide accurate health information
- Only upload records you own or have authority to share
- Consult healthcare providers for medical decisions
- Not rely solely on our reports for medical decisions
7. Prohibited Uses
Do not:
- Use the Service for unlawful purposes
- Upload health information belonging to others
- Attempt unauthorized access to our systems
- Resell or commercially exploit the Service
8. Intellectual Property
The Service is owned by WhatsAilingMe™ and protected by intellectual property laws. You retain ownership of your health information. Reports are for personal use only.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE SERVICE. OUR REPORTS ARE FOR INFORMATIONAL PURPOSES ONLY AND ARE NOT MEDICAL ADVICE.
10. Limitation of Liability
WHATSAILINGME™ SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED FEES PAID IN THE PRECEDING 12 MONTHS. WE ARE NOT LIABLE FOR MEDICAL DECISIONS BASED ON OUR SERVICE.
11. Third-Party Services
We integrate with Quest Diagnostics for lab testing and payment processors. These services have their own terms and privacy policies.
12. Termination
We may terminate your account for breach of these Terms. You may terminate anytime by contacting us. Upon termination, your right to use the Service ceases.
13. Governing Law
These Terms are governed by Delaware law. Disputes will be resolved in Delaware courts.
14. Dispute Resolution
Before filing a claim, contact legal@whatsailingme.com to resolve disputes informally. Unresolved disputes will be settled through binding arbitration.
15. Changes to Terms
We may modify these Terms at any time. Continued use after changes constitutes acceptance.
